Making a business decision...

Hey Lugster - If you don't think you're feeling the love from other Bottomfeeders like myself and others, you got it wrong. Nobody likes going thru an awful lot of trouble and playing by the rules, only to have what appears to be a bias against us as a legitimate trustee sale buyer.

My personal opinion is about the same as Brian H who I've observed to be a pretty sharp operator: Getting deals is still a numbers game.

Was it Ron LeGrande (?) who said: "Some do, some don't; some will. some won't."

If you really, really want the property, run the numbers based on the costs of funds, legal, etc. and move forward.

Since I am more often a lender foreclosing than a buyer, these days, I look at both perspectives about the same. For a lender, the point of the trustee sale is to sell the asset as an offset to pay for the debt, presumably with as little expense and drama as possible, in order to satisfy as much of the note as possible. Added factors include banks who are sensative to consumer pressure and, in CA, foreclosure trustees who have no upside to seeing that your sale is completed. After all, to a trustee, its' just another sale.

So, if you feel like this is your place to fight the good fight, sue. Otherwise, decide where your efforts are best directed to make Lughead LLC the most money for effort and capital expended.
