I agree, they shouldn't be allowed to do that. You need to pull out the HOA CCRs and find the section of their own CCRs that clearly state that the lien is not transferred to a new owner in the event of foreclosure. Can you imagine if the bank became the new owner - they would not get away with charging them all the back HOA fees. But, on the other hand, the banks are drowning in so much paper they would probably accidentally just pay the thing.
