Hey Rick, I did read and understand what the guy is asking. One of the posts above states the following:

The current owner, we'll call him Joe, bought the house from the life estate tenant, we'll call her Mary, a few years ago. Mary was in foreclosure. Joe offered to buy the house subject to. Mary agreed on the condition that she gets a life estate and only pay $500 a month.

The reason I asked for clarification is because the legality of the scenario would determine my advice. If doing a subject to equity purchase with a owner occupant in foreclosure and then basically renting back to them is legal there are few options beyond cash for keys or some form of payment to vacate the tenancy.

If the above scenario violates CA civil code my advice would be to stay away. Hence my inquiry for clarification on the law based on what the scenario described above.
