Lug - you ask the right questions. I think I'm qualified to address the issue of lawsuits better than many ;)...

While it MAY be possible to perfect title by fighting the "good fight" is that a practical approach, righteous or otherwise?

Place yourself in the courthouse now. There are jurors of your peers (?) looking at you and, despite your best attempts, will you appear to be a sympathetic plaintiff? The lender's attorney(s) will be there with the doe-eyed foreclosed homeowners and, as if on cue, will testify how they had worked with the lender to come up with a solution, when the juggernaut trustee 'accidently' took the property to sale.

That's the three steps to being screwed by the system which does not even attempt to protect the investor. In the meantime, you will have "invested" perhaps $30K - $80K+ into legal costs for attorneys, discovery & countless hours of your own time that are gone...forever. Hours that could have been spent with your new baby.

No one said this is fair. If you had oodles of time and money to burn, then go for the lawsuit. However, the opportunity cost is definately a factor.
