Hello Kristine,

Thank you for the reply. Would you happen to have the case law that you refer to?

We have defended lawsuits following foreclosure in the past. Took about 1.5 yrs to conclude and funds to defend.

Our main question is how much to go down the litigation route (again) versus doing 2 or 3 transactions in the same time period.

In my opinion, the lender is in the wrong, yet they can still file a unilateral recssion which is what we may allow them to do as it will still give us the option to file a Quiet Title action. Based on their paltry offer, there is really no reason to take it.

Specific case law would be wonderful to review if you have it.
