Innovest Resource Management BBB Business Review

Abusive HOA Fees

December 20, 2011 07:23PM
I totally agreed that there should be more government control on abusive HOAs. I recently received a letter from HOA regarding a satellite dish that no one knows when it was installed on my unit. They asked us to remove it and pay for roof repair(the roof is fine, NOT leaking at all if the dish remains there) or apply for HOA's Architectural approval. We owned the unit for 2 years and never approved any installation. It's probably leftover from the previous owner. The dish company agreed to come over and remove it and repair the roof. But the HOA insisted they repair the roof and will charge us $65/hour for work + $65/hour for managing/inspecting/coordinating the repair/shopping for materials/dumping materials). We have no right to work on it because it's their roof. I called the dish network. They told me that there was no recent installation record. However, they can not put that in writing or release any record unless subpoenaed. But HOA insisted we provide them with paper work from dish network. So I told HOA that, by law, we are innocent until they can prove us guilty. The burden is on them to find the document from dish network and show it to us. The story with this HOA can go on and on: their board meeting is never held in the complex, the HOA due has to be mailed to a PO box in Arizonia, then recently change to a PO box in San Francisco...
they are just hiding things. But as an inverters, you can't get on the board. So be careful when buying condos, allow enough margins.
