I think the question is are you willing to take on the risk of the former owner's appeal (or endless appeals) without insurance. Because that's what bonding around something is about. You are essentially saying this issue is such a non-issue that you don't need insurance for it. You would be self insuring. And if you are not comfortable with bonding around, you are asking an insurance company to do something you won't do yourself. Surely you can see that no premium is big enough for a wild card like a former owner with a known pattern of law suits.

If the title company will hold the $150K, what's your take on how much might get used up in the next year if the title company gets named in a suit. Does this former owner have a lawyer? Do you have any sense if the former owner can be bought out? Or are they really suffering from some serious entitlement issues?
