appeal holding up sale

Does anyone know of a title company that is willing to take on more risk (in return for a higher premium) than most? I have a million dollar + property that is in escrow to a ready and willing cash buyer and the former owner is holding up the sale through a recent appeal of an order expunging the lis pendens. I can explain in more detail if more details are needed. Overall, title companies don't want to insure this transaction (they can, just dont want to) because based on the history of this former owner, they believe they will be dragged into a lawsuit and have to defend themselves. Basically they want to wait for the appeal to take place (about 9 months out) before they will insure. Thoughts?
