If there is not a recorded Lis Pendens, hurry up and record your Trustee's Deed as soon as you get it. Then go get title insurance immediately after recording. As long as there isn't a Lis Pendens recorded naming your specific property it should be OK in the eyes of the title company.

The case is between the prior owner and the bank. Just as long as they keep it between themselves you should be OK.

Another note, the bank can conduct a foreclosure with a Lis Pendens or any other lien or cloud on the property. The only thing that can truly stop the sale is a live bankruptcy case or irregularities in their noticing or sale process. Trustee sale buyer assumes all title liability.
