Title company making mistakes? Let's see....today I had to fax back re-dos of three docs because the escrow officer made a big typo on the price. We are days away from closing and I didn't catch it, but the seller did. I could not for the life of me figure out why the numbers on the estimated closing statement were so off, so I sent what I knew was needed for closing anyway. When she received my check, she said I sent too much. Never occurred to me that she was working with the wrong purchase price.
If there is a mistake in your situation, I'd bet on recording. The escrow companies where I am don't prepare 80/20 loan or concurrent loan docs without stamping them with specific ordering instructions. They use the stamp to indicate order and/or subord. in the escrow instrux. and on the face of DOTS. The recorder could mess that up too, but at least there is language to make the intent clear.
