80/20 in ca 580b nightmare won't end

November 13, 2011 01:16PM
Well this isn't my first post here but I honestly thought I was done ever posting here.

Quick refresher,

I got an 80/20 loan through Eloan that was serviced, both halves by popular bank in mid 2007,
About six months in, the first mortgage was sold to national city mortgage. Later on the second mortgage was sold to bofa. Anyways in mid 2010 the home was foreclosed on and it was sold by the bank in November 2010. I continually got notices from the second mortgage requesting payment and threatening to send me to further collections. I also got multiple phone calls asking for payment even after I was no longer the legal owner of the property.

Now I'm in ca. We have ccp 580b which basically states that I am not liable for the deficiency left over for the loan if the house is foreclosed. There are loopholes but it was my primary residence and I met all the requirements. No one wants to lose their house but I did and it sucked but when does the nightmare end?

So I send everyone the cease and desist letter basically saying stop harassing me with your phone calls and daily letters. I send the letters to everyone including popular who just re-bought the second mortgage.

It's been six months of quietness until this week. Now am I missing something? Or is this just what these lenders do?

Are they going to keep mailing me notices because they can? Im legally protected if I go to court, but at what point do they just leave you be? When does it just close? Do they try to sue you or attach wages and then you go to court or what? The money just keeps compounding. I don't know. Is this just reality of foreclosure or should I do something to try and get them to COMPLETELY leave me be? You finally try to turn the corner move forward and start over but some companies just won't let up.
