How does Civil Code 2924h come into play. If the bankruptcy is filed the same day as the Trustee Sale and a Trustee's deed is recorded within 15 days, who should prevail. Under code 2924h. the sale is deemed to have occured at 8:00 a.m. the day of the sale. It is impossible to record a BK at 8:00 as the court does open until 9:00 a.m.
