Good points from Ward here regarding the time you can buy if you stall a Trustee's Sale by filing a BK without notifying the trustee before sale. Of course you would notify the trustee of the timely filing of the BK after the sale, and throw all kinds of wrenches into the works. Why not buy yourself several additional weeks before a stay is lifted and a new sale is scheduled? Except for the part, especially these days, where the lender is dropping their minimum bid to get it sold. Guess who suffers the most inconvenience? I think it's your fellow investor, if you believe in such fellowship. You know, the one who bought the property as a bonafide purchaser at sale. The one who brought the cash and did their due diligence and showed up with cash at 10:00 am and started the process of eviction.....that guy/gal. I think this strategy was all well and good when the lenders were getting back most of the properties. Somehow it was OK to mess with their resources, their attorneys, their trustees. But the investor with cash standing on the sidewalk, hoping/assuming their purchase is a good one? Is all fair in love and foreclosure?
