Property is in California.

Lien was filed March 2011. The contents of the lien indicates that work started in 2007. This is probably the only true thing about it. (I believe the work was completed in 2007 but I cannot prove it). The foreclosing lien was from 06/2008.

So far, the ML would be senior to the foreclosing TD.

However, no court action within 90 days, I think this makes it invalid.

No contractor's license.. makes it un-enforceable as well.


The title company withholds $50k 'until this is cleared up'. 2 other title companies were not even willing to limit it to $50k. They believed I had to pay the guy off.

Ok. I may do that.


My question: Can a person go around and record MLs against properties without just cause? I feel this should be punishable as it hurts me now.
