This is the kind of thing that gives agents a bad name: asking for and/or making unnecessary paperwork. :) You don't need a copy of the promissory note in order to negotiate a short sale. If I were the lender, I wouldn't give it to you either. They are not required to do so at this point. Make your offer and wait for their response. If you come to an agreeable payoff then they'll have to produce the note and there are remedies if they don't have it.
