Same when a property owner dies leaving real property. It's not common, but it does happen. I've made what other would call a pretty good living from finding these anomoloies on a serial basis.

You mighthave received better/quicker/more intelligent responses than mine had your original post been more focused. Also, you don't appear to need help so that may be why other posters were not rushing to address your queries. Given that this is an investors forum I've observed many more people with well-thought-out responses replying to an investor who is mid-deal or struck on how to commence or structure a transaction.

I'm no different: Hypothetical questions are neither urgent nor essential, especially on a free forum. It would be great to read how you are trying to buy the asset as a principal from one or both trust bene's. Also, the successor trustee could decline to serve and both could nominate you as new trustee, if you don't mind the fiduciary duties and implecations.

It's obvious that you've given these questions lots of thought, though.
