Thanks for your reply. Yes, I'm in a community property state. Since posting this I've confirmed what you said. Several lawyers indicate that so long as I can prove they were sole and separate, non-commingled funds, i should be ok protecting my interest in the property. From a loan standpoint, I've heard from a couple lenders that If I have my co-signor put on title (and optionally myself) but do not attempt to owner occupy the property (though my co-signor can), that I wouldn't have to get an interspousal transfer of interest agreement signed in the escrow process as a precondition for either funding or the escrow closing. Does anyone else have experience or knowledge which corraborates this or qualifies it? Many thanks for any insights...
