        <title>Can I buy a property with a conventional loan as a married person who might not get interspousal transfer deed?</title>
        <description> I want to buy a property and have qualified with my dad for a loan on it.  However, I'm not sure that my marriage is going to hold up and am not sure if my wife will sign off on an interspousal transfer deed to divest her interest in the property I wish to buy during escrow.  If I release all my contigencies and then find out the escrow can't close because my wife won't sign the interspousal deed (and we don't want to put her on title), I could lose a sizeable deposit.  I've heard mixed stories on whether title companies or lenders will let you close a deal in a community property state without getting such a document signed.

Can anyone please offer insights on whether I could succeed with completing such a transaction without having the document signed, and if there is more than one way to get it done, please let me know so I'll have a backup plan.

            <description><![CDATA[ Thanks for your reply.  Yes, I'm in a community property state.  Since posting this I've confirmed what you said.  Several lawyers indicate that so long as I can prove they were sole and separate, non-commingled funds, i should be ok protecting my interest in the property.  From a loan standpoint, I've heard from a couple lenders that If I have my co-signor put on title (and optionally myself) but do not attempt to owner occupy the property (though my co-signor can), that I wouldn't have to get an interspousal transfer of interest agreement signed in the escrow process as a precondition for either funding or the escrow closing.  Does anyone else have experience or knowledge which corraborates this or qualifies it?  Many thanks for any insights...]]></description>

That being the case there is little to nothing you can do to keep your wife from holding some interest in whatever you purchase.  <br />
<br />
It being understood that the funds are since your marriage. <br />
<br />
However if you can prove they are your separate funds, accrued prior to the marriage and kept separate, you may have a chance to do something..]]></description>
