judge doesn't like redacted amounts on trustee's deed

October 29, 2011 11:15PM
Our eviction attorney attempted motion of summary judgement on a property in Los Angeles (unlawfule detainer). I did not attend the hearing but our attorney said the judge did not like the fact that we blacked out the amount paid at trustee sale on the certified copy of the trustee's deed. The judge continued the hearing and ask for certified copy with no black out amounts. We ordered new trustee's deed from trustee. We recorded new trustee's deed (without blacking out dollar amount paid). At time of recording the county clerk asked our runner to write a short explanaition of redundant recording in the margin of the trustee's deed. At the next hearing, the judge said he didn't like hand writing on margin and scheduled a trial in 3 weeks.

1) Has anyone experienced any problems with redacting the amount paid at trustee sale on the trustee's deed. Given the fact that this particular unlawul detainer has been difficult, I don't think I will black out the amounts any longer.

2)What is the real benefit of blacking out the amount paid when every buyer's lender ask for auction receipt anyway?

You don't need to "black" out...try whiteout.
