Innovest Resource Management BBB Business Review

Sticky title problem

October 13, 2015 02:34PM
Elderly reverse mortgage borrower has been under Power of Attorney since 1991. Original ink-signed POA document has been misplaced. Daughter (attorney) doesn't have it, either. Lawyer who drew up the POA all those years ago signed a notarized affidavit as to the authenticity of the copy of the POA but title company says, "No original ink-signed POA, no title policy."

What might be a get-around for this problem? Elderly borrower no longer has capacity to sign a new POA. I don't know which title company they're dealing with, but would another title company be less dogmatic about this issue? Can an extra bond be purchased to cover just this issue?
