I was inquiring with my title company about this same issue. According to my title company, the assgnment just has to be recorded prior to the Notice to Sell, not prior to the Notice of Default.

So, call your title company (or start getting a title company) and ask them to run a title search on your property and issue title insurance. Get an opinion from them and forward that opinion to someone involved. If a Lis Pendens has not been recorded against the property.

This happened to a friend of mine and he was tied up for over 1 year. The prior owner had to pay monthly rent to the bona fide purchaser (although they were always late or bounced check)
