Innovest Resource Management BBB Business Review

Foreclosure expiration?

August 19, 2013 11:16AM
I have an investment property where foreclosure proceedings began 2 years ago and then the bank sold the note to a private investor shortly thereafter. The private investor has never contacted me for payment or responded to any of my inquiries to him for payment details. As a result, I have not made a payment in 2 years.

Can the private investor assume ownership of the foreclosure proceeding filed by the prior lender, or do they have to refile?

Does a foreclosure proceeding "expire"? If not for the original lender, is there potentially an expiration if it transfers ownership and no action is taken by the new "lender?"

Can I dispute the foreclosure proceeding with the bureaus given nothing has happened in over 2 years and the new "lender" is unresponsive despite multiple attempts to contact?

Given that there was a foreclosure started and not completed, along with no payment history for 2 years, does this mean that the "clock" has not started on my credit to start repairing?

Thank you for your time and expertise, in advance.
