It sounds like you want to create a tenancy but without having to give the proper 30/60 day notice to get them out.

If you accept any rent you then have created a tenancy. Hence, it makes sense to have him sign a month to month agreement outlining your expectations.

In terms of proper notice, now that they are a tenant of yours you have to serve them with a 30 or 60 day notice. A 30 day notice is proper if the tenant has not lived in the property for more than year. However, he was the owner during that year and has been a tenant less than a year. I am not sure how the courts will treat that. Your safe bet is to give them a 60 day notice to terminate.

Why don't you try to sell the property while they are still living there?
