Deed-in-Lieu or Deed in the Loo?

Hey Bill - I miss your posts here. You are officially admonished for your absence.

Maybe I'm missing the point here, but is it that the lender gets marketable title without having to foreclose?

If so, isn't lender stuck with any junior baggage that attaches? Wouldn't a deed from owner/borrower to lender's other enitity circumvent that issue expeditiously? The lien release/recon now makes it harder for lender to perfect title by wiping off juniors. Also, release does not address the matter of the debt instrument (note).

I'm always eager to learn. How is your way preferable? Many thanks/
