The tax certificates were sold during a mortgage foreclosure that stretched on for years. They were given a first lien. The sheriff's website says all property taxes would be paid from the sale proceeds yet no one ever notified the certificate holder of the sale or that proceeds were available. The certificates were NOT paid off. The certificates were not voided or the liens removed. The buyer was then told he is responsible for paying the liens on top of the sale price. This is problematic for many reasons:
The Sheriff's website stated that taxes would be paid.
The home had previously been offered for sheriff's sale twice and the price was to be further reduced. This action raises the price. Any appraiser, after determining a sales value, would expect an assumed lean to reduce the cash paid roughly equally. The county required every penny to be paid then slapped the buyer with this lien.
There are no laws that barred the court from notifying the certificate holder of the proceeds. The court allowed a judicial report that was 14 months old at the time of the sale. As a former mortgage broker, I have never seen a loan close with a title search over 90 days old.
I was hoping to find similar cases in other counties or states.
