Innovest Resource Management BBB Business Review

Surplus funds of Decedent's loan

October 31, 2011 08:32AM
I've done a number of CA overbids of decdent's loans. Normally have to probate as the value of total gross assets as of date of death is > $100K

These occassionally do fall thru the cracks.

Trustee has no particular due diligence required to track anyone down (i.e. heirs) beyond noticing recorded owners of interests and voluntary lienholders (plus IRS). Laws specific to surplus funds are CC 2924 J-K

There are plenty of unrecorded creditors who may claim a sizeable piece of the estate (overbid) such as Medi-Cal before heirs/beneficiaries get what's left after attorney. I usually give finders up to 10% of what I get, Sometimes it's a good-size number, and sometimes Medi-cal wins.
