Accommodation recording by a title company...

How about someone that records a short form deed of trust as canceled/paid off when in fact it wasn't. Then records a new one with a different lender and has the title company perform the recording. Basically fraud. Is the title company liable because they recorded the document?

Mike,

Title companies record lots of documents as a free service to the requesting public. But when they do, they almost always disavow any liability for providing such an accommodation by noting on the face of the recorded document the words Accommodation Only. So if any fraud results in the transaction they are deemed to be non-complicit.
