I only work CA deals and we've been selling this way for many years (since the 1980's).

Although I hold a CA broker's license, I haven't sold my own properties for a long time, either. Consequently, we use the CAR Probate Advisory form which both affirmatively notices buyers of the exception regarding omission of the TDS but also lists which disclosures are required.

As a caveat, I always disclose any potentially negative information that I am, in fact, aware of, and have pretty heavy "As-Is" language written into an addedum of every offer.
