That's a bummer. Attorney has a good point and I'd side with their logic.

You're Dad's foreclosure trustee should have been consulted before taking this action independently.

Debtor will claim that these payments apply to past installments, if the breach triggering the NOD was for failure to make same.

Loosing time is not the same as loosing money. That's a different lesson.
