I am not sure what "his company" consists of. If its "John Jones, dba the Jones Company", I'd think the deal would be very shaky. If its some other form ownership I'd think it would work. Even a general partnership with his wife should be ok.

I'd be careful about foreclosing on the second td to wipe out the HOA lien. First, the foreclosure will be expensive. Second, that would place ownership in the name of the foreclosing entity. If he ever again acquires title to the property in his own name, the HOA lien will re-attach.
