Civil Code §1695 states that if you don't have the requisite 5 days left then the seller's right to cancel truncates to 8:00am on the morning of the scheduled trustee's sale.

You are the first person to ever train us, back in 2002 and we still use your exact same method to buy subject to without title/escrow using FITE when there is not enough time for it. But I still haven't really figured out how to buy and adhere to the 5 day rule when someone wants to sale t minus <5 days. We can't record a grant deed to protect us so we can reinstate until the day of sale, but that doesn't give us enough time to make sure nothing is recorded ahead of us...can this even be done? Thanks!
