The Affadavit of Memoradum shouldn't trigger the recorder to ask you any questions about the ownership. Was the purchase option attached? Also, in my county you can waive the Prelim. Change of Ownership by paying a $20 fee. They don't tell you that when you are standing there, but it is published info. I just refuse to fill it out and pay the $20.00. May I suggest that you run your option and memorandum by a real estate attorney? Recording has become pretty technical. The point of your memorandum is to cloud title if your seller tries to around you. You want to make sure that it is executed right, not just recorded. Sincerely, Kristine
