Ask a title officer or certified escrow officer...In Reply to: Re: Recording Memorandum of Option - San Diego posted by Kristine-CA on June 29, 2003 at 11:45 AM : Eric: I am wondering exactly what docs you were trying to record. The Affadavit of Memoradum shouldn't trigger the recorder to ask you any questions about the ownership. Was the purchase option attached? : Also, in my county you can waive the Prelim. Change of Ownership by paying a $20 fee. They don't tell you that when you are standing there, but it is published info. I just refuse to fill it out and pay the $20.00. : May I suggest that you run your option and memorandum by a real estate attorney? Recording has become pretty technical. The point of your memorandum is to cloud title if your seller tries to around you. You want to make sure that it is executed right, not just recorded. : Sincerely, Kristine Kristine, Haven't you noticed that most attorneys in CA don't know too much about real estate matters? That's because they don't get a lot of real estate legal experience in this state since we don't usually use attorneys in our buying and selling of property. We use the services of title insurance and escrow instead. So most CA attorneys don't know anything about the technicalities of recording a document in the county recorder's office. The people who know this stuff are title officers and escrow officers.
