Rent Skimming. Clarification needed.

I read the CA code on rent skimming. I'd appreciate clarification on one point. I'm considering putting a renter into a property that is going towards foreclosure. I've contacted the bank and the loss mitigation rep told me to go ahead and rent it!!??!! I offered the rents to the bank, and she was not interested, even though it is the banks right under the Deed of Trust. Crazy, but true.
If I've owned the property for longer than one year, does the code not apply?
