Innovest Resource Management BBB Business Review

February 12, 2015 09:49AM
Hi Ward,

FAQ 69 in the California Franchise Tax Board document I reference above says when a trust holds title, all withholding forms should be completed using the grantor's information. The way I read that is if the grantor is a corp I could check box #6 on the form you referenced and be exempt from the withholding ... No??

69. When a trust holds title to the property, who is
considered the seller?
If the trust is a grantor trust, then the seller
is the grantor. Usually the grantor of a
trust is an individual. All withholding forms
should be completed using the individual’s
(grantor’s) information.
