Deceased owner left no will, and has a house worth $300,000 : 2. $100,000 is owed, leaving a lot of equity. Furthermore, the grand daughter living in the house wants to work with us. : 3. The grand daughter who is about 28 years old, if that is important, says the house may be secheduled for probate auction, but I definately know from a research tool that it is scheduled to be forclosed on in about 10 days. : My question is, how can we prevent probate action, get the house put into someones name that we can then make a deal with? : Best Regards, Nathan Nathan, Before I respond, please clear up a couple of things: 1. Has probate been opened? 2. If so, who is the administrator? 3. Is it the County Public Administrator? 4. Have you confirmed that a probate auction is scheduled or not? 5. Would the other heirs assign or release their interests to you? 6. Would Granddaughter move if given an incentive to help contact the people and not interfere? 7. Would she be willing to serve as administrator if no one has been appointed? 8. Anyone else on title? 9. If a California file (you didn't clarify) did decedent receive any Medi-Cal benefits from D.H.S.? THis ought to get you started. Suggest you always state what State/County you're dealing with. No one's gonna snake you deal with only that info. However, it'll go a long way to getting an answer more applicable to your locale. Hope this helps!
