It is in California and no the seller is not in default. I posted
this here because I know that Ward gives good advice. I am well aware
of the foreclosure laws in Ca. I am also set to take one of Ward's
training sessions on Pre-foreclosures next week.

All offers were made between our agents. Sellers fired their
agent after they accepted our offer and after signing the
contract. Their broker advised them to break their contract
and not sell to us.

As far as taking advantage of an unsophisticated older couple and
reading between the lines I have to laugh. This couple has rental
properties in 4 different states and are much more experienced
than me and my partner. It was not until we experienced these
problems that I have learned that this seller has had this
house fall out of escrow five times due to pulling these
kind of stunts. Should we let this go and have the next
unsuspecting buyer deal with her as we have had to or do we have
an ethical/moral responsibility to stop her. This is not
about the money now. As I stated in my message I was paying cash
for the property. This was not hard money cash but my out of
pocket cash...

I am sorry if I sound defensive regarding taking advantage
of people but I would never do any such thing especially
when it is only about money.
