You do not give sufficient information in your post.

What state is this in?
Is the Seller in Default?

These can be very important bits of information in answering how to deal with the matter.

Did you present the offer to the Seller directly or to the agent ? As you know or should know if it is listed with a Realtor, your agent is obligated to deal with the Seller's agent.

It does sound as though they are breeching their contract.

It also has a ring of taking advantage of some unsophisticated/older folks (this is reading between the lines)....Ward has repeatedly made it a point to NOT take advantage of people!

It is my understanding that in a state such as CA if a judge/jury considers your deal as "Unconscienable" that they can impose severe penalties upon you.
