Contracting with someone who's in bankruptcy..In Reply to: bankruptcy question posted by gcastro on May 28, 2003 at 2:24 PM
: Ward, I just found someone who is in forclosure, and she said that she has filed bankruptcy chap 13, but the are still in the process of doing that, so I guess the process has not been completed. What would you suggest I do? Tell her to cancell the bankruptcy? Can I buy the property even though they have filed bankruptcy? Yes you can, but make sure you get the approval of the bankruptcy trustee or judge for your deal. That's because while someone is in a bankruptcy action they don't have total control of their assets and so selling any of them requires the Court's permission. They will often OK a deal if they think it improves their client's position.
