Here's the workaround...In Reply to: request from bank posted by Camille Calenda on March 11, 2004 at 10:28 PM : Hi Ward-- : I put our own residence into a THT and notified the bank with the letter, a copy of the transfer deed and the certificate of trust. The bank called me and asked for a copy of my trust agreement because they said the trustee was not myself or Nick. I told the representative that the certificate of trust that I provided is all that is needed. She said they needed to see that we were the owners or bene's so I faxed her just the bene page from the trust agreement. Shortly after I received a letter from the bank saying that the title transfer was approved but they included a trust agreement and they said "please have the enclosed trust agreement executed and return it along with a check for $250". I guess since I would not give them my trust agreement they made one up that they want us to sign. How do you suggest I handle this request? : Thank you, ================== Camille, I think you handled the bank OK and that they won't be heard from again. However, if they call you just stonewall them with something like you want your attorney's OK first, etc. Now, I think you're going to get an inquiry letter from your County Assessor's office since they won't be sure if you're still the owner either. They will ask you to bring your trust declaration down to their offices to make sure you're the beneficiaries of the new trust too. I have been able to satisfy the Assessor's office by going down and just showing them the 3rd version of the Certification of Trust you have in your trust manual. The 3rd version has an extra line stating that the two beneficiaries of the trust are you and Nick! I also let the Assessor's clerk know that for privacy purposes I won't give them a copy or let them copy the Certification. From now on, whenever you transfer title into a title holding trust (THT) that doesn't bear your name and doesn't use you as the trustee, employ the 3rd version of the Certification of Trust that shows you are the beneficiaries.
