This TD is dated/written earlier by 10 days than a larger $ deed on the prop. but recorded on the on the same day with a recorded document number after the larger dollar amount deed. The question- which is the senior/1st deed, the deed written first or the deed recorded first. Because if the smaller amount deed is the first and is bought at auction will it not wipe out the larger amount deed? Thanks for your help. Chris I would be interested in a second opinion. It is my understanding that a purchase TD (which the larger amount TD likely is) still gets priority position if the date it was signed precedes even the recording date of a non-purchase TD (provided it is recorded within 10 days). All other TD, leins, etc. are in race mode. Maybe this is not true in CA.
