Just look further back in time for FITE...In Reply to: Title Question... posted by jom-CA on February 26, 2004 at 9:10 AM : Hello Ward : I'm doing a title search on a property that hasn't (not yet anyway) gone into foreclosure. Here is what I've found: : A Deed, a Trust Deed and then an assignment of Trust Deed all back to back recorded. While looking for the beginning point (FITE) everything seems in order EXCEPT "F". The deed is actually a Quit Claim Deed listed as a "gift" with no transfer tax. What can be determined from this situation? What else should I be looking for? There aren't any AITD's, none recorded anyway. Any ideas? BTW, the property has been financed again since this initial transfer so it seems it was refinanced BUT what position this new loan is in could be in question. ??? : Thanks Ward : jom
Jom, The process of finding a reliable point in time, where the property was free and clear, requires you keep going back in time until you do find FITE. There just aren’t any exceptions to finding ALL the elements of FITE.
