Dealing with two sellers/brothersIn Reply to: Deposit Check - Need Payable to Both Parties? posted by Alexis (CA) on October 30, 2003 at 12:01 AM : If I am giving a deposit (outside of escrow) to two brothers (or sisters) to buy (tie-up) their property, do I have to write the check payable to both of the brothers? Or can I just write it to one of the brothers? : I want to make it more convenient for them. However, I don't want a loophole for them to back out of our purchase agreement. : Also, is it better to have both brothers sign one deed--having to record only one deed? Or is it better to have them sign two separate deeds? =?=?=?=?=?=?=?=?=?=?= Alexis, I'd make it payable to both of them. Their two endorsements would prove they both knew and approved of the deal.
