Deposit Check - Need Payable to Both Parties?

If I am giving a deposit (outside of escrow) to two brothers (or sisters) to buy (tie-up) their property, do I have to write the check payable to both of the brothers? Or can I just write it to one of the brothers?

I want to make it more convenient for them. However, I don't want a loophole for them to back out of our purchase agreement.

Also, is it better to have both brothers sign one deed--having to record only one deed? Or is it better to have them sign two separate deeds?
