Gary,

I don't think it's going to be insisted on for deals that are a couple of years old.

But if it is, you could always go shopping for a title company that won't require an AoD, especially in a large, metropolitan area like San Diego, Los Angeles, San Francisco, Sacramento, etc. that have 15 to 20 local title companies.
