: : Hello Ward,
: : Is it common for a Title Co. to request an Affidavit of Deed on a property that is being held in a Title Holding Trust.

: : At this point title has requested the Cert. Trust & Trust Declaration, which I have supplied to them.

: : Why would they request an Affidavit of Deed if Title was held in a trust, where I hold the ABI.

: : At this point how should the Affidavit of Deed be executed from A-Z

: =?=?=?=?=?=?=?=?=?=?=

: Gus,

: Title companies seem to come up with just about anything they can think of. Nothing surprises me at this point in my career.

: I know it sounds crazy, but go back to the owner and execute a notarized Affidavit of Deed for the transfer deed that was recorded to transfer the title from themselves into the trust.

:
: Hope this helps.

Ward:

Do you know if this a go - no go issue for the title companies? I have a transaction from a couple of years ago where if I had to locate them to execute an Affadavit of Deed, I may not be able to locate the sellers.

Thanks,
Gary
