You're OK...In Reply to: served properly? posted by gcastro on September 04, 2003 at 6:52 PM
: I am wondering wether I served a 60 day notice on my tenants properly. This is how I proceded: First, I went by the property and left a copy with an adult tenant, on July 9, 2003. Then, I wanted to make sure that the tenants wouldn't say that they never got it, so what I did is I sent them another copy by certified mail, on July 15, 2003. Did I proceed correctly? Gonzalo, You're OK. You don't have to personally serve every tenant on your premises. Serving one of them is sufficient to effectively give notice to them all. So your subsequent service by certified mail six days later wasn't required. Thus it will be treated as harmless overkill. But the next time you do a "nail and mail" service of notice do them both contemporaneously...the same day at least. Hope this helps
