: A home owner contacted me and he is in foreclosure on his ONE and only TD which was a refi in November. When I did a title check a TD that used to be a 2nd had not been reconveyed. The owner tells me it was paid off along with the previous 1st (which WAS reconveyed) due to the refinance. I believe him in that there was NO subordination of this 2nd on record at the time of the refi. My question is: who to contact about getting this done? Is it the 2nd beneficiary (which was a private loan) or the Trustee of that 2nd?

I am not sure if other would answer the same as me. But, if the county shows no REC on the 2nd mortgage, but the first was a refi and no subordination I would contact the escrow/title company listed on the current 1st trust deed. They would have clear record of such transaction. There information is printed on the front page of the TD. If that is fruitless, I would call the Benificary over the trustee.
