Close your escrow and then sue them in small claims court. In Reply to: Fairbanks Capital posted by Jim on July 24, 2003 at 5:28 PM
: I took title to a Nevada property by Deed in Lieu of Foreclosure. I reinstated the 1st loan using the figures FC gave me. FC's trustee recorded rescission to their NOD. I now have property sold and Fairbanks has added an additional $2,000 to the pay off figure for "Attorney's fees" they say they "forgot to add to the reinstatement figures". Do I have any recourse, or am I at their mercy? They have been almost impossible to work with at EVERY step in trying to get this loan paid off. Jim, My thoughts in these type cases always goes to completing your sale. Keep your eye on the big picture rather than risk the expeditious close of your escrow while you argue with the likes of FC. Once you close escrow then sue them at your leisure in Small Claims Court (where you will probably win).
