Lug -

If the PIQ is owner occupied, 1-4 residential units, and you can't confirm that a Notice of Recission (NOR) has been recorded,
the owner is still entitled to the 5 day right of cancellation.

: we found a house while driving around FSBO

: when we knocked - they are in CH 13 - want to convert to a CH 7 and sell the home

: if they are in BK but there was a NOD filed in the past and payments are current in the BK - should we do an EPA agreement as our contract or a regular Purchase Offer??

: if an EPA - do we need to wait until the 5 days are up to put an Earnest Money deposit into escrow? - I would think not since we are not giving them money, but to the Title Co.
